Please read these terms carefully before using Haul Ship Sphere's shipping, tracking, and logistics services.

Article 1

Acceptance of Terms

By accessing, browsing, or using any services provided by Haul Ship Sphere ("the Company," "we," "our"), including but not limited to our website, tracking portals, shipping services, and customer support channels, you ("the User," "Customer," "Shipper") acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

  • These terms constitute a legally binding agreement between you and Haul Ship Sphere effective from your first use of our services.
  • If you are acting on behalf of a business entity, you represent that you have the authority to bind that entity to these terms.
  • We reserve the right to modify these terms at any time. Material changes will be communicated via email or prominently displayed on our website at least 30 days prior to taking effect.
  • Continued use of our services after amendments are posted constitutes acceptance of the revised terms.

⚠️ If you do not agree with any part of these Terms & Conditions, you must discontinue use of all Haul Ship Sphere services immediately.

Article 2

Service Description

Haul Ship Sphere provides the following logistics and courier services, subject to availability and applicable regulations:

  • Express Courier Delivery: Domestic and international door-to-door parcel delivery with real-time tracking manifest visibility.
  • Air Freight Express: Time-critical cargo transport via partnered commercial and chartered cargo airlines.
  • Ocean Cargo Carriers: Full Container Load (FCL) and Less-than Container Load (LCL) maritime freight forwarding services.
  • Land Distribution: Regional and continental ground transportation via our fleet of trucks and partner road haulage networks.
  • Warehousing & Fulfillment: Short-term and long-term storage at bonded warehouse facilities with inventory management capabilities.
  • Customs Brokerage: Documentation preparation, tariff classification, and regulatory compliance for international shipments.
  • Real-Time Tracking: Web-based and API-accessible shipment tracking with milestone notifications via email and SMS.

Service availability, transit times, and pricing may vary by route, destination, shipment characteristics, and prevailing market conditions. All quoted transit times are estimates and not guaranteed unless expressly stated in writing.

Article 3

Shipping Liability

While we take every reasonable precaution to ensure the safe transit of your shipments, the following liability terms apply:

  • Standard Liability: Our standard liability for loss or damage is limited to £50 per kilogram of the affected shipment or £500 per consignment, whichever is lower, unless additional insurance has been purchased.
  • Packaging Requirements: The Customer is solely responsible for ensuring all items are adequately packaged to withstand normal conditions of transport. Claims arising from insufficient packaging will not be honored.
  • Delay Liability: We are not liable for delays caused by force majeure events including but not limited to: natural disasters, severe weather, government actions, customs delays, pandemics, civil unrest, or carrier strikes.
  • Indirect Losses: Under no circumstances shall Haul Ship Sphere be liable for indirect, consequential, incidental, or punitive damages including lost profits, business interruption, or loss of data.
  • Declared Value: Shipments must be declared with an accurate value at the time of booking. Undeclared or misdeclared items may result in reduced compensation and potential service termination.

📋 All damage or loss claims must be submitted within 21 calendar days of the scheduled delivery date with supporting documentation (photographs, invoices, receipts).

Article 4

Prohibited & Restricted Items

The following items are strictly prohibited from shipment through Haul Ship Sphere. Attempting to ship prohibited items may result in immediate confiscation, service termination, and legal prosecution:

  • Hazardous Materials: Explosives, flammable liquids/gases, radioactive materials, corrosives, toxic substances, and oxidizing agents (unless pre-approved under IATA DGR protocols).
  • Illegal Goods: Narcotics, counterfeit products, stolen property, unlicensed firearms, and any items prohibited under the laws of origin, transit, or destination countries.
  • Perishable Goods: Unpackaged food items, live animals, and biological samples unless shipped under our specialized temperature-controlled service with prior arrangement.
  • Currency & Negotiable Instruments: Cash, bearer bonds, unregistered securities, cryptocurrency hardware wallets containing private keys, and loose precious stones.
  • Human Remains: Cremated remains require special handling permits and must be shipped in approved containers only.
  • Unpackaged Liquids: Loose or improperly sealed liquid containers that may leak during transit.

Article 5

Insurance & Claims

Haul Ship Sphere offers optional enhanced insurance coverage to protect your shipments beyond standard liability limits:

  • Standard Coverage: Included at no additional cost with every shipment, covering loss or damage up to the standard liability limits defined in Article 3.
  • Enhanced Coverage: Available at an additional premium calculated as a percentage of the declared shipment value. Covers loss, damage, and theft up to the full declared value.
  • Premium Coverage: All-risk insurance including coverage for delays exceeding 72 hours beyond the estimated delivery window, with expedited replacement or reshipment options.
  • Claims Process: Submit claims via our online portal or by contacting our Claims Department. Required documentation includes: proof of value (purchase receipt or invoice), photographic evidence of damage, tracking number, and a signed claim form.
  • Claims Timeline: Claims must be filed within 21 days of delivery (for damage) or within 45 days of the scheduled delivery date (for loss). Late claims may be rejected at our discretion.
  • Resolution: Approved claims will be settled via bank transfer or account credit within 30 business days of claim approval.
Article 6

Payment Terms

The following terms govern all financial transactions between you and Haul Ship Sphere:

  • Pricing: All shipping rates are quoted in the currency applicable to your region and are exclusive of VAT/GST, customs duties, and import taxes unless explicitly stated otherwise.
  • Payment Methods: We accept Visa, Mastercard, American Express, PayPal, bank wire transfers, and approved corporate account billing. All card payments are processed through PCI DSS Level 1 certified gateways.
  • Payment Timing: Shipping charges are due at the time of booking for individual shipments. Corporate account holders operate on Net-30 payment terms with approved credit facilities.
  • Additional Charges: Surcharges may apply for remote area delivery, address corrections, re-delivery attempts, dimensional weight adjustments, customs processing, and fuel surcharges.
  • Late Payments: Overdue corporate invoices will incur interest at 2% above the Bank of England base rate per month. Persistent non-payment may result in service suspension and referral to collections.
  • Refund Policy: Refunds for canceled shipments are issued minus a processing fee (10% of the shipping cost or £15, whichever is greater). Shipments already collected cannot be refunded but may be redirected for an additional fee.
Article 7

Limitation of Liability

To the fullest extent permitted by applicable law, Haul Ship Sphere's aggregate liability under these Terms shall be subject to the following limitations:

  • Maximum Liability Cap: Our total liability for any single claim or series of related claims shall not exceed the greater of: (a) the shipping fees paid for the affected consignment, or (b) the applicable insurance coverage limit purchased.
  • Excluded Damages: We expressly exclude liability for loss of profits, loss of revenue, loss of business opportunities, loss of data, reputational damage, or any indirect or consequential losses however arising.
  • Force Majeure: We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including natural disasters, pandemics, wars, government restrictions, carrier insolvency, or infrastructure failures.
  • Contributory Negligence: Liability may be reduced or excluded where the Customer's actions or omissions (including inadequate packaging, misdeclaration, or providing incorrect addresses) contributed to the loss or damage.
  • Time Limitation: Any legal proceedings arising from these terms must be commenced within 12 months of the event giving rise to the claim, after which all rights to claim shall be deemed waived.

⚖️ Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Article 8

Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the following legal framework:

  • Applicable Law: These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  • International Conventions: For international carriage, these terms are subject to the applicable provisions of the Montreal Convention (air freight), the Hague-Visby Rules (ocean freight), and the CMR Convention (road freight) where mandatory.
  • Arbitration: For commercial disputes exceeding £10,000, both parties agree to first attempt resolution through mediation administered by the London Court of International Arbitration (LCIA). If mediation is unsuccessful within 60 days, the dispute shall be referred to binding arbitration.
  • Consumer Rights: Nothing in these terms affects your statutory consumer rights under applicable consumer protection legislation. Where local law provides greater protection, those provisions shall prevail.
  • Severability: If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
  • Entire Agreement: These Terms & Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Haul Ship Sphere.
